
According to the Methodology of organizing HIA studies for certain public and private projects, (Order of Ministry of Health no. 1524/2019, published in the Official Gazette, Part I no. 840 of October 16, 2019), Art. 10. – (1) The impact on the health of the population is evaluated, as the case may be, by a prospective / concomitant / retrospective evaluation study of the operation of a project, based on the documents submitted by the project holder, provided in par. (2) and (3).
(2) List of documents submitted by the project holder for the elaboration of the HIA study in the case of the functional objectives that are submitted in the procedure for the environmental impact assessment, according to the provisions of art. 9 paragraph (1) and (2) of Law no. 292/2018 for the projects provided in the annex no. 1 to the same law, is the following:
a) the written request to elaborate the study;
b) the written decision of the Public Health Authority to the project holder regarding the necessity of the study for the objective located in the rounded territory, mentioning the classification of the objective / activity in the situations provided by the legislation;
c) report on the environmental impact study, including a pollutant dispersion study and conclusions regarding the level of emissions in the neighboring inhabited area;
d) geotechnical study, as the case may be;
e) sun study, as the case may be;
f) the urban planning certificate;
g) the documents of ownership / renting of the used space;
h) cadastral documentation;
i) the instrument of incorporation, the registration certificate and the status of the applicant company;
j) the technical data sheets and notices established by the urban planning certificate;
k) the zoning urban plan (PUZ);
l) situation plan specifying the distances from the perimeter of the unit to the facade of the neighboring buildings;
m) description of the construction and operation project;
n) technical report, including the distances from neighbors on each cardinal landmark, the structure of the construction, the functional description of the objective with the descriptive charts, the interior and exterior finishes, the connections to utilities, the sources of pollutants and the protection of the environmental factors, ecological reconstruction works and measures for environmental monitoring;
o) description of the technological process from entry to exit – text and drowings specifying the production capacity and presentation of raw materials, reagents, chemicals, etc. used to obtain finished products;
p) in the case of the objectives that have worked / are presented the following documents: environmental analysis bulletins (water, air emissions / imissions, noise, as the case may be), monitoring plans, existing permits, environmental balances, annual environmental reports and other documents at the justified request of the developer;
q) other opinions and agreements (for situations where opinions and agreements are needed at local / national level).
(3) The list of documents submitted by the project holder for functional objectives that are not subject to the environmental impact assessment procedure is as follows:
a) request to elaborate the study;
b) the written decision of the public health directorate regarding the necessity of the study for the objective located in the rounded territory;
c) architectural statement;
d) complete technical report, drawn up according to point VI letter. A of the annex no. 5.E to the procedure provided in annex no. 5 to Law no. 292/2018;
e) sunlight study, as the case may be;
f) classification notice or notification issued by the territorial public authorities for environmental protection organized at the county level and at the level of the Bucharest municipality;
g) urbanism certificate;
h) identity documents of the beneficiary;
i) documents of ownership / renting of land / space;
j) registration certificate in the Trade Register (CUI);
k) cadastral documentation;
l) plan for framing the area;
m) situation plan specifying the distances from the perimeter of the unit to the facade of the neighboring buildings;
n) description of the technological process from entry to exit – text and sketches specifying the production capacity and presentation of raw materials, reagents, chemicals, etc. used in obtaining finished products – if applicable;
o) other opinions and agreements (for situations where opinions and agreements are needed at local / national level).
(4) The HIA studies provided in par. (1) establish the measures related to the impact of the activity of a functional objective on the health of the population and contribute to the decision of the decision-making forums for realizing, not realizing or stopping its functioning.
According to the methodology (art. 12),
(2) The HIA study for functional objectives that are subject to the environmental impact assessment procedure, according to the provisions of art. 9 paragraph (1) and (2) of Law no. 292/2018 for the projects provided in the annex no. 1 to the same law, will contain the following chapters:
a) purpose and objectives;
b) the opposite of documents that were the basis for the elaboration of the study;
c) general and location data;
d) identification and evaluation of potential risk factors for the health of the population in the environment and factors of discomfort for the population, which are mentioned in each subchapter:
1. the existing / proposed situation, the possible risk to the health of the population;
2. health risk assessment: hazard identification, exposure assessment, dose-response relationship assessment, risk characterization;
3. mandatory recommendations and measures to minimize the negative impact and maximize the positive one;
e) alternatives, if applicable;
f) mandatory conclusions and conditions;
g) summary, comprising: a description of the project with information on its location, conception, size and other relevant characteristics, a description of the possible significant effects of the project on the health of the population in the area of influence, conclusions and recommendations.
(3) The HIA study for functional objectives that are not subject to the environmental impact assessment procedure will contain the following chapters:
a) purpose and objectives;
b) the opposite of documents that were at the elaboration of the study;
c) general and location data;
d) identifying and evaluating potential environmental risk factors and discomfort for the population, which is mentioned in each subchapter;
1. the existing / proposed situation, the possible risk to the health of the population;
2. mandatory recommendations and measures to minimize the negative impact and maximize the positive one;
e) alternatives, if applicable;
f) mandatory conclusions and conditions;
g) summary, comprising: a description of the project with information on its location, conception, size and other relevant characteristics, a description of the possible significant effects of the project on the health of the population in the area of influence, conclusions and recommendations.
The duration of an HIA study depends on the complexity of the objective and the working time of the experts (consultancy, documentation analysis, performing specific evaluations – eg. dispersion calculations, risk matrices, drafting / verification of documents) – often between 7 and 30 days. upon the complete submission of the documentation.
Each study has its own specificity – the calculation of the tariff will be made according to the complexity of the documentation, the value of the investment, the importance of the study in carrying out the approval procedures, the qualification of the personnel involved and the number of hours needed to prepare the study, to which the overhead costs are added. Payment of the services will be made in cash, by payment order or postal mandate, according to the ones established in the contract.
According to the Methodology, Art. 13. – (1) The HIA studies shall be submitted by the HIA applicant to the Public Health Authorities (PHA), whose territory is located the functional objective.
(2) The final form of the HIA study is made available to the decision-makers and the technical analysis committee, in order to make the optimal decisions to increase the positive effects on the health status of the population and to develop strategies to improve the negative effects.
Art. 12. (5) The summaries of the HIA studies are submitted to the comments of the interested public by posting on the website of the public health director who made the decision to conduct the health impact assessment study, and the motivated proposals / recommendations are taken into account in the quality analysis phase of HIA studies.
(6) The local PHA analyze the quality of the HIA studies and decide their acceptance or restoration.
(7) Based on the studies of the HIA, the county PHA and the municipality of Bucharest formulate points of view regarding the significant direct and indirect effects of a project on the population and human health, according to the provisions of art. 12 paragraph (7) of Law no. 292/2018.
